By using the Platform, you represent and warrant that:

• You meet the eligibility requirements
• You have the legal capacity to enter into these Terms
• Your use of the Platform complies with all applicable laws and regulations

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the confidentiality of your login credentials
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or pose security or legal risks.

Fanthq is a lifestyle social platform enabling users to share and engage with aspirational and lifestyle content. Core mechanics include:

• "Fancy" (what users have or admire)
• "Fantasy" (what users desire or aspire to)
• Content sharing via images, videos, and text
• Social interactions, including comments, messaging, and sharing
• Group participation ("Clicks")
• Monetization via stores and gifting

"User Content" means any content you upload, post, or share on Fanthq.

4.1 Ownership — You retain ownership of your User Content.

4.2 License to Fanthq — By posting content, you grant Fanthq a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, distribute, modify, display, and perform your content for purposes of operating, improving, and promoting the Platform.

4.3 Content Responsibility — You are solely responsible for your User Content and agree not to post content that:

• Is illegal, harmful, defamatory, or misleading
• Infringes intellectual property rights
• Contains hate speech, harassment, or threats
• Includes explicit or exploitative material
• Violates privacy or publicity rights

You agree not to:

• Use the Platform for unlawful purposes
• Impersonate others or misrepresent identity
• Interfere with or disrupt the Platform
• Attempt unauthorized access to systems
• Use bots, scraping, or automated systems without permission
• Engage in fraud, spam, or manipulation of engagement (e.g., artificial "Fancy" or "Fantasy")

Fanthq introduces unique engagement signals:

• Fancy: Express admiration or approval of content
• Fantasy: Express aspiration or desire

These interactions do not imply endorsement, ownership, or intent to purchase. They may be used to personalize content recommendations and influence content visibility via our algorithms.

Your use of Fanthq is subject to our Privacy Policy.

• Public accounts may have content visible to anyone, including non-users
• Private accounts restrict access to approved followers
• Users may organize followers into Inner Circle and Outer Circle, which may affect visibility of certain interactions or content

Fanthq allows private messaging. You agree not to send spam, harassment, or harmful content. Messages may be processed to ensure safety and prevent abuse.

We reserve the right to monitor or remove content that violates these Terms.

Users may create or join groups ("Clicks"). Group creators and members agree to maintain respectful and lawful interactions. Fanthq may moderate, suspend, or remove groups violating policies.

Fanthq may enable commerce features, including user-created stores and digital or physical gifting.

• Transactions may be facilitated by third-party payment providers; Fanthq is not a party to transactions between users unless explicitly stated
• Gifts may be sent without sharing personal addresses; fulfillment may involve third-party logistics partners
• Users and sellers are responsible for product accuracy, compliance with laws, delivery, and customer service

Fanthq may grant verification badges to notable users or brands. Verification does not imply endorsement and may be revoked at any time.

All Platform content (excluding User Content), including logos, design, features, and software, are owned by Fanthq or its licensors and protected by intellectual property laws.

You may not copy, modify, distribute, or reverse-engineer the Platform without permission.

We may remove or restrict content, suspend or terminate accounts, and limit access to features if we determine violations of these Terms or risks to users or the Platform.

You may stop using Fanthq at any time. We may suspend or terminate your account if you violate these Terms, if required by law, or if necessary to protect the Platform or users.

Fanthq is provided "as is" and "as available." We do not guarantee continuous availability, accuracy of content, or that the Platform will be error-free or secure.

User content does not reflect Fanthq's views.

To the fullest extent permitted by law, Fanthq shall not be liable for indirect, incidental, or consequential damages, loss of data, profits, or reputation, or user interactions or transactions.

You agree to indemnify and hold harmless Fanthq from any claims arising from your use of the Platform, your content, or your violation of these Terms.

We may update these Terms from time to time. We will notify users of material changes. Continued use of the Platform constitutes acceptance.

These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Any disputes shall be resolved through good faith negotiation first, then binding arbitration (if applicable under local law). Users waive the right to participate in class actions where permitted.

These Terms are between you and Fanthq only, not with Apple or Google.

• Subject to your compliance, Fanthq grants you a limited, non-exclusive, non-transferable, revocable license to download and use the app on Apple-branded devices (per App Store rules) or Android devices (per Google Play rules)
• You may not reverse engineer, decompile, or modify the app or use it in violation of platform policies
• Apple and its subsidiaries are third-party beneficiaries of these Terms
• Fanthq is solely responsible for maintenance, support, product claims, and intellectual property claims
• Payments may be processed via Apple In-App Purchases, Google Play Billing, or approved third-party processors

Fanthq maintains safeguards to prevent harassment, bullying, exploitation, harmful behavior, and fraudulent activity. Users may block or report other users and control visibility via privacy settings.

Fanthq strictly prohibits content involving exploitation or abuse of minors and may report violations to law enforcement and immediately terminate offending accounts.
